What are the OSHA toilet requirements on an Idaho construction site?

OSHA rule 29 CFR 1926.51(c) requires 1 toilet for 20 or fewer workers. Crews of 20 or more need 1 toilet seat and 1 urinal per 40 workers. Crews of 200 or more need 1 toilet seat and 1 urinal per 50 workers.

Number of workersOSHA minimum (Table D-1)
20 or fewer1 toilet
20 or more1 toilet seat and 1 urinal per 40 workers
200 or more1 toilet seat and 1 urinal per 50 workers

A standard PolyJohn PJN3 unit has both a toilet and a urinal. One standard unit counts as 1 seat and 1 urinal.

Examples

  • For example, a crew of 12 needs 1 unit.
  • For example, a crew of 60 needs 2 units (60 ÷ 40 = 1.5, rounded up).
  • For example, a crew of 250 needs 5 units (250 ÷ 50).

Who enforces OSHA toilet rules in Idaho?

Federal OSHA enforces job site toilet rules for private employers in Idaho, because Idaho has no state OSHA plan. The OSHA Boise Area Office covers the state. Contractors in Boise, Meridian, Nampa and every other Idaho town follow the same federal 29 CFR 1926 rules.

That makes Idaho simpler than states with their own plans. There is one rule book for private builders.

Local building departments do not set toilet counts. Inspectors on site look at the OSHA standard. Public employers follow separate rules, so check with your agency.

Does OSHA require handwashing on a job site?

OSHA rule 1926.51(f) requires lavatories in all places of employment. The rule calls for running water, hand soap, and towels or air blowers. Mobile crews with transport to nearby washing facilities are exempt. Most fixed job sites in the Treasure Valley add a hand-wash station.

A two-station hand-wash station holds 22 gallons of fresh water and has two foot-pump sinks. Monthly service refills water, soap and towels.

In winter, fresh water can freeze below 32°F. Read the winter porta potty guide for cold-weather options.

What are the OSHA toilet rules for farms in Idaho?

OSHA rule 29 CFR 1928.110 covers farms with 11 or more hand laborers in the field on any day. The rule requires 1 toilet and 1 handwashing facility per 20 workers. Both must sit within a quarter-mile walk of where the crew is working.

Orchards, onion fields and seed crops in Canyon and Payette counties often reach 11 workers at harvest.

  • Work of 3 hours or less per day, including travel, is exempt.
  • Where terrain blocks access, place units at the closest vehicle access point.
  • Toilets need ventilation, screens and self-closing doors.

Do construction porta potties need to be ADA accessible?

Construction porta potties used only by construction workers do not need to be ADA accessible. Section 203.2 of the 2010 ADA Standards exempts them. Public use changes that, such as a model home open house. Then plan at least 5% accessible units per cluster.

Some general contractors still add one wheelchair-accessible unit. Inspectors, owners and injured workers can use it. The PolyJohn We'll Care III has a 60-inch turning circle and a ground-level floor.

Compare sizes on the ADA porta potty rental page.

How often should a job site porta potty be cleaned?

A job site porta potty on a monthly rental gets 1 service visit per week. Each visit includes a pump-out, wash-down, sanitizing and paper restock. Crews over 10 workers or heavy-use sites should add a second weekly visit to keep the unit clean.

OSHA does not list a cleaning schedule. A full, dirty unit sends workers off site to find a restroom.

A standard unit costs $165 per 28-day cycle. Zone 1 adds a one-time $75 delivery and pickup fee. There is no long-term contract. Start with construction porta potty rental in Boise.

Related questions

How many porta potties do I need for 3 workers?

A crew of 3 workers needs 1 porta potty under OSHA Table D-1. That single unit covers up to 20 workers. Weekly service is included on a monthly rental, which is enough for a small crew.

Is a painting contractor at a house considered construction?

Painting, remodeling and repair work count as construction under OSHA 29 CFR 1926. A crew may use the house restroom only if the homeowner allows it. Otherwise, the crew needs a toilet on site.

Can my crew use a gas station restroom instead?

Only mobile crews with transport readily available to nearby toilets are exempt from 1926.51(c). A crew working all day at one site needs a toilet on that site. Daily trips to a gas station also cost paid work time.

Do I need a separate urinal for a large crew?

OSHA counts 1 toilet seat and 1 urinal per 40 workers for crews of 20 or more. A standard porta potty has both a seat and a urinal inside. One standard unit meets both parts of that count.

Can I get invoiced monthly for job site toilets?

Approved contractor accounts can pay by invoice on Net 15 terms. Other renters pay by card at booking. There is no deposit, no card fee and no fuel surcharge on monthly rentals.
